After Christmas – legal help is availabe against foreign traders

After the holiday season it can happen that the product ordered from a foreign trader as a Christmas gift breaks down and the foreign seller does not respond to the consumer’s complaint and fails to perform the consumers’ guarantee rights. It is also common that in the case of a product bought from a foreign web shop the seller neglects the buyer’s right to return and withdraw without the need of giving any reason.

In such cases it is very important for consumers to know that there is a forum that can provide substantive help even with their complaint against a foreign trader. In the case of a cross border consumer complaint, if the seller has its seat in another Member State of the European Union, or in Iceland or Norway respectively, for Hungarian consumers the European Consumer Centre (hosted by the Hungarian Authority for Consumer Protection) provide free professional and legal help towards contacting the company, furthermore attempting to solve the complaint and to assert consumer rights.

With the help of the ECC long-drawn cross border litigation can be avoided and an agreement can be reached between the parties concerned that can thus mean the actual settlement, resolution of the complaint.

It shows the efficiency of the ECC that the claims of European consumers (from Hungary and other Member States) the ECC successfully asserted in 2014 amounts to 16.342.000,- HUF, from that sum Hungarian consumers received 10.738.000,- HUF. Consumers whose complaints were solved successfully could avoid the potential additional costs of cross border litigation (costs of legal representatives, judicial costs, costs of translation etc.) too.
